How much access will I have to my kids?

It is the policy of Texas to encourage frequent contact between a child and each parent for periods of possession that optimize the development of a close and continuing relationship between each parent and child. For that reason it is presumed that the standard possession order should be awarded at a minimum, unless there are reasons why that would not be in the best interest of a child. More visitation may be awarded.

The standard possession order is as follows:

For parents that reside 100 miles or less apart:

  1. First, third and fifth weekend of each month;
  2. Thursday nights;
  3. Every other year for spring break;
  4. Thirty days in the summer;
  5. 1/2 of Christmas Vacation; – From when the child is dismissed from school for Christmas break to noon on December 28th and the following year noon on December 28th to the child returns from Christmas break for school;
  6. Alternating each year for Thanksgiving;
  7. At least two hours in the evening on the child’s birthday;
  8. Father’s Day Weekend for Fathers; and
  9. Mother’s Day Weekend for Mothers.

For Parents that reside OVER 100 miles apart:

  1. Either first, third and fifth weekend or at least one weekend per month;
  2. Every Spring Break;
  3. 42 days during the summer break;
  4. 1/2 of Christmas Vacation; – From when the child is dismissed from school for Christmas break to noon on December 28th and the following year noon on December 28th to the child returns from Christmas break for school;
  5. Alternating each year for Thanksgiving;
  6. At least two hours in the evening on the child’s birthday;
  7. Father’s Day Weekend for Fathers; and
  8. Mother’s Day Weekend for Mothers.
